§ 1 Scope

These Terms apply to all consumer purchases via tragsmomente.com and tragsmomente.de.

§ 2 Contracting Party

§ 3 Conclusion of Contract

Listings are non-binding. By clicking “Buy now”, you place a binding order. A contract is formed upon our acceptance or dispatch confirmation.

§ 4 Prices & Payment

EU/DE: EUR incl. VAT. USA/Canada: USD. Other countries: as shown at checkout. Customs/taxes outside the EU are borne by the customer. Payments: Credit card, PayPal, Klarna, Shopify Payments (provider fees may apply).

§ 5 Production & Delivery

Print-on-demand via partners (Printful Inc. / Printify Inc.). Total delivery time = production + shipping. See Shipping & Delivery.

§ 6 Retention of Title

Goods remain our property until fully paid.

§ 7 Returns & Withdrawal (Print-on-Demand)

(1) EU/DE: 14-day right of withdrawal for non-personalized items; no withdrawal for customized goods (per § 312g BGB / EU Directive). Details and the model withdrawal form are provided in “Returns & Withdrawal (Print-on-Demand)”.

(2) USA/Canada: No general statutory right of return. Returns only for defects, misdelivery, or transport damage (within 30 days of receipt).

(3) Return workflow, time limits and addresses follow “Returns & Withdrawal (Print-on-Demand)” and the Shipping & Delivery.

§ 8 Warranty

EU/DE: statutory 2-year warranty. International: local consumer protection rules apply.

§ 9 Product Specifics (Print-on-Demand)

  • Minor color deviations between screen and print are unavoidable.
  • ±5% tolerances in size/placement are industry-standard.
  • Batch-related material variations may occur.

§ 10 Liability

Unlimited liability for intent, gross negligence, injury to life/body/health, and product liability. For slight negligence, liability is limited to essential duties and foreseeable damages.

§ 11 Contract Language & Storage

For EU/DE customers, German is the contract language. An English version is provided for international customers. Order details and these Terms are sent by e-mail.

§ 12 Governing Law

German law applies (excluding CISG). Mandatory consumer protection rules of your country of residence remain unaffected.

§ 13 Dispute Resolution

The EU ODR platform has been discontinued (20 July 2025). Info on ADR: consumer-redress.ec.europa.eu. We do not participate in consumer arbitration.

§ 14 Fulfilment by Third Parties

Production & shipping via Printful/Printify; the contracting party remains Dmytro Serdiukov & E-Commerce.

§ 15 Intellectual Property

All designs/graphics are protected. Customers warrant rights for uploaded content and indemnify us against third-party claims.

§ 17 Changes

We may amend these Terms for legitimate reasons (law, services). The current version is published on our website.
